Termes and Conditions

Yamina Tours LLC. (Hereafter referred to as “Yamina Tours”, “we”, “us”, “ourselves”) accepts bookings subject to the following conditions. Except where expressly stated, these conditions only apply to tour arrangements booked by the client with the Company and which the Company agrees to make, provide or perform (as applicable) as part of their contract with the client. All references in these conditions to “tour”, “booking”, “contract” or “arrangements” mean such tour arrangements unless otherwise stated.

Personal Information Collected

When the customer uses our services, Yamina Tours may collect and hold personal information such as:

  • your name, date of birth, gender, postal address, telephone number, email address, passport details, medical information and travel insurance details (where applicable);
  • details of the products and services you have purchased from us or which you have enquired about, together with any additional information necessary to deliver those products and services and to respond to your enquiries; and
  • any additional information relating to you that you or a third party has provided to us directly or indirectly through our travelers’ or agents’ phone enquiry lines, websites, online presence, customer surveys.

Information that we collect (about your health or religion) may be considered “sensitive information”.  We collect it to provide you with our services that cater to your needs or act in your interest, and we are only prepared to accept sensitive information on the condition that we have your consent.  

If you visit our website or use our applications, we may also collect information that is not personal information to improve the experience for our customers. This information may include the pages you visit, your IP address, browser type and language, and the date and time of your visit. We cannot identify you individually from this information. Some of this information is collected using cookies.

When you are travelling with us, we may take videos and images of you that may be used in brochures, in our advertising or on our website. All participants of Yamina Tours trips authorize us to use her/his image (such as a photograph, videotape, film or pictorial representation or recorded voice). If you do not wish for this to happen, please notify us in writing.

Booking Terms

Prices

All prices are given at the bottom of each tour, day trip, or weekend, and all notes of what is included/not included are as listed there. Prices are always given per person and according to the number in the group: 1, 2, 3, 4, 5, or 6. Please contact us for a quotation for parties larger than 6.

Reservations

Booking a tour with Yamina Tours can be made via phone, using our contact form or by email.

Deposit

After we confirm your tour to you in writing, we ask you to pay a non-refundable deposit of 30% of the total tour cost. Deposit payments can be made by electronic bank transfer or by credit card via PayPal. Details of how to pay the deposit will be sent to you in writing when we confirm availability. All the bookings are secured after we receive the initial deposit. For short notice bookings, we would require a good faith deposit. The remaining balance is due 30 days prior to the departure date depending on the trip. We reserve the right to treat your reservation as cancelled if your final payment is not made when due.

Payment

We give you the flexibility to either pre-pay the final balance within the month prior to your trip or to settle the balance via your tour driver/guide. If you choose to pay the driver/guide, the remaining balance is to be paid in cash (Dirhams, Pounds, USD, or Euros). Credit/Debits cards are NOT accepted locally for security reasons. If you choose to pay the balance a month before your trip, payments can be made by electronic bank transfer or by credit card via PayPal. Details of how to pay the balance will be sent to you in writing at the time of payment.

Cancellation by client

You must notify us in writing by email should you wish to cancel a tour. Cancellation is effective on the date we receive your notification. The following charges are applicable upon cancellation:

• 6 weeks: Full refund minus 10% as our admin fee.

Cancellation / alterations by us

Due to the nature of our tours, certain situations (adverse weather conditions for example) may mean that we will need to make changes to the expected itinerary of your chosen tour. If this is the case, we will advise you as soon as we become aware of any such situation. We will do everything in our power to keep the tour as close to the original itinerary as possible. In some cases, however, we may be forced to cancel the tour for reasons beyond our control “force majeure”. If this is the case, you will be entitled to a full refund minus any costs already incurred by us. If we cancel a tour for any reason other than force majeure, you will receive a full refund from us. No further compensation will be payable by us.

Accommodation

Accommodation can vary in quality according to local standards in Morocco and should be judged accordingly. Hotels, riads, and guesthouses are booked according to availability. Where possible, we’ll inform you of a variety of choices, including upgrades requiring any additional fee.

Special requests

Please inform us at the time of booking about any special requirements you may have such as dietary requirements, king-sized beds according to your height and so on. We will do our best to meet these requirements as far as they are available in Morocco, but they cannot be guaranteed.

Your responsibilities:

Travel Insurance

You must be adequately covered by comprehensive travel insurance which must include cover for medical emergencies and the cost of rescue/evacuation where necessary. It is your responsibility to check that any adventure sports/activities (including but not limited to camel trekking, horse riding, quad biking and water sports) that you try on your tour are covered by your policy.

Passports, visas and vaccinations: 

Clients are responsible for arranging, and must be in possession of a valid passport with 6 months validity from the tour start date and any visas and vaccination certificates required for their whole journey and tour. Information about these matters or related items (climate, clothing, baggage, personal gear, etc.) is given in good faith but without responsibility on the part of Yamina Tour. We regret that we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry all required documentation. If failure to have any necessary travel or other documents results in cancelation of your trip, we will not be obliged to refund you any amount deposited.

Flights

Your air travel will be booked independently of any booking with us. We have no involvement and accept no liability for this element of your tour and it is your responsibility to familiarize yourself with the terms and conditions of your air travel provider.

Illness and/or Disability

Please notify us in writing in advance of the tour regarding any illness and/or disability that may affect your ability to take part in your chosen tour.

Personal Property

You are responsible for all personal property & travel documentation during the tour and we accept no liability whatsoever in this regard.

Complaints

If you have any complaint about any of the tour arrangements, you must bring it to our attention at the time so that we may use all reasonable endeavors to rectify the situation. Failure to complain at the time will affect any further claim you make against us.

Should the problem remain unsolved, a complaint must be made in writing to us within a reasonable period of no more than 3 weeks after the completion of the tour.

If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services.
